GENERAL TERMS OF SALE

Registering for services supervised by Damien MAVAUT, Mountain Guide D.E., or by another Mountain Guide D.E. implies the full and unconditional acceptance of these general terms and conditions by the subscriber, who agrees to inform each participant of all the details.

1 – Damien MAVAUT, through the website “dam-nature04,” offers mountain guiding services, including survival and wellness courses. All Mountain Guides who may be called upon to lead the offered services meet the same requirements.

3 – Scope of application of the general conditions applicable to the supervision of sports activities
These general conditions can be modified at any time. The regulations applicable to the booking of a sports activity are those in effect at the time of booking.

3.1 These general conditions apply between Damien MAVAUT and all individuals making a booking via the website https://www.dam-nature04.com, by email, or by phone to carry out one of the offered activities.

3.2 Eligibility of individuals making a booking: individuals making reservations on the Dam-nature04 website must be at least 18 years old and have legal capacity or possess parental authorization.

3.3 Minors under 18 years old who are not accompanied by an adult (legal guardian) are not accepted in so-called "group" activities.

3.4 Our activities are open to everyone; however, depending on the activity and itinerary, certain conditions must be taken into account: age limit, technical or physical level, contraindications… To know these conditions, please refer to the product fact sheets (available on our website www.dam-nature04.fr). 3.5 Dam-nature04 may publish photos taken during the activity on social networks (Facebook, Instagram, Twitter…) or on the Dam-nature04.com website, provided that participants have given their prior consent. Important: if you depend on particular medical treatments or care, or if your health condition requires special attention, you must inform the instructor before the start of the activity.

 

4 – Offers – Booking Conditions

4.1 Availability of offers: The sports activity offers presented on the website dam-nature04 www.dam-nature04.fr are those available at the time of registration. All our activities are by reservation. For this, you have several options: online booking (www.dam-nature04.com), by email (damnature04@gmail.com), or by phone (+33 6 08 30 76 54).

4.2 Different booking methods Online booking Payment is made in full at the time of online booking. Payment signifies the conclusion of the contract. It is confirmed by sending an email. For more details, refer to Article 5 of these General Terms and Conditions of Sale. Telephone Any booking made by phone will be considered a pre-booking and requires payment of the activity to be confirmed as a reservation. Quote Any request for a quote is made by email or phone. The offer must be signed and returned by email or by post along with the payment of the deposit.

All bookings are confirmed upon receipt of the deposit payment.

4.3 For group bookings, a deposit will be required. The balance will be due before the start of the activity. For group registrations, the subscriber agrees to inform each participant of the content of the activities and the corresponding practice conditions. 4.4 Instructor commitment: The instructor commitment includes an instructor assigned for one or more clients. The rate for this service is flat and depends on the activity and the course selected. 4.5 Gift voucher: The gift voucher is valid for 1 year from the date of purchase. After the validity period, the service will be considered fulfilled and cannot be postponed. The beneficiary and/or purchaser cannot claim any refund or compensation. The gift voucher becomes effective upon receipt of the full payment of the service. The gift voucher beneficiary must contact us to book the activity.

The outing will be guaranteed provided that the minimum required number of participants is met and that the weather conditions allow for the proper practice of the activity. The activity on the gift voucher can be replaced with another activity offered by Dam-nature04, provided that its value is equal to or less than the activity mentioned on the gift voucher. However, it is possible to undertake an activity of a higher value by paying the difference.

5 – Formation of the contract for online sales

5.1 The client confirms that they have read the offer proposed by Dam-nature04 on the website www.dam-nature04.com. The database on the Dam-nature04.com website allows the client, before concluding the contract, to know exactly the essential characteristics of the service they wish to order, such as: "location, type of service, etc."

5.2 For any additional information, the client can send an email through the contact section of the website (www.dam-nature04/contact) or call (+33) 6 08 30 76 54.

5.3 Reservations and orders placed by the client through the Dam-nature04 website bind the client and imply acceptance of these general terms and conditions.

5.4 To validate the registration, the client must provide Dam-nature04 with the following information: last name, first name, year of birth, address, contact phone number during the stay and/or mobile phone number, number of people, names of the people and years of birth, valid email.

5.5 After paying for their order, the client will receive their itemized invoice, which will include the price, full description of their sporting activity (activity details, date, time, and meeting places) by email.

. 5.6 Insurance We cannot substitute for individual civil liability. It is essential to have comprehensive insurance covering cancellation / repatriation / illness / travel accident / loss or theft of luggage / mountain rescue / trip interruption.

6 – Rates and Payment Method

6.1 The rates shown on the website are in euros (VAT not applicable, art. 293 b of the CGI). Prices include: the supervision service provided by a state-certified guide and the loan of technical and/or safety equipment necessary for practicing the chosen activity, as specified on the website. We invite you to refer to the product datasheet, available on our website or upon request

Prices do not include: transportation to the activity location (meeting point and site), personal expenses, meals (lunch, picnic, water, snacks) which are the responsibility of the client, unless otherwise stated.

6.2 Dam-nature04 reserves the right to modify its prices at any time, it being understood that the price shown on the website (https://dam-nature04.com) on the day of the order will be the only one applicable to the buyer.

6.3 In the event that a typing or calculation error results in an obviously absurd price, Damien MAVAUT reserves the right not to honor the order and, if applicable, to refund the buyer within 30 days.

6.4 Accepted payment methods: cash, bank checks, credit cards, bank transfers. For supervision services, payment must be sent (made out), directly to the attention of Damien MAVAUT.

.7 – Supervision​
7.1 All proposed activities are supervised and ensured by state-certified mountain guides who comply with their legal obligations (U.R.S.S.A.F, R.C.P, D.D.C.S.P.P declaration, professional cards). Outdoor activities take place in a natural setting, without any modifications. Engaging in these activities involves taking risks. Risk assessment leads to technical, human, and material decisions. The instructor is there to evaluate and minimize these risks. Under no circumstances do they replace the environment or eliminate all potential hazards. Mountain Guides are state-certified professionals. Participation is subject to their assessment, which will be based on the moral and physical abilities of the participants. The Guide reserves the right to refuse participation or to direct certain participants toward a different activity.

. La faisabilité de l’activité ne dépend pas d’une réservation, mais de paramètres multiples concourant au bon déroulement de la pratique. Tout programme est soumis à l’appréciation de l’Accompagnateur en fonction des conditions météorologiques et de l’aptitude morale et physique des participants. Les moniteurs pourront donc, à tout instant, choisir un parcours plus adapté.

7.2 Une heure et un lieu de rendez-vous vous seront systématiquement communiqués quel que soit la prestation. Pour le bon déroulement des activités et par respect envers les autres participants et le professionnel qui vous encadre, nous vous prions de bien vouloir prendre connaissance des feuilles de route et autres indications préalablement transmises par nos soins. Veillez à anticiper vos trajets de manière à être ponctuel. Nous tolérons un retard de 15 minutes maximum. Au-delà de ce délai, les Accompagnateurs partent en activités et aucun remboursement ou indemnité ne sera exigible

8 – Termination / Changes
8.1 Cancellation Conditions Weather conditions are in no case a reason for cancellation or postponement as long as the activity is taking place; no refund or rescheduling will be provided. The Guides reserve the right to modify or change the usual routes. Adapting routes according to the weather is in no case a reason for cancellation. Any service interrupted or not used due to insufficient physical and/or technical level or due to an injury occurring during the activity will not result in any refund or exchange of the service.
8.2 Cancellation by the professional If the safety conditions are not considered optimal by the professional before the start of the activity, or if the number of participants is insufficient (less than 4 people), the activity may be canceled, and the client then has the option to:

Carry out another activity as a replacement. If the replacement activity is less expensive, a billing adjustment will be made. Move the activity session to another day. Agree to a credit equal to the amount paid without being entitled to any other compensation. Agree to a refund without being entitled to any other compensation.

8.3 Cancellation by the client Any cancellation by the client before departure must be sent to us by registered letter with acknowledgment of receipt. Your withdrawal will result in the following deductions: Cancellation of a reservation more than 15 days before the start of the service: Damien MAVAUT will refund the amount paid minus administrative fees (10% of the transaction with a minimum of 20 euros). Cancellation of a reservation within 15 days before the start of the service: subject to a case of force majeure with supporting documentation, Damien MAVAUT will refund the amount paid minus a processing fee (10% of the transaction with a minimum of 20 euros). In the absence of a force majeure event: Damien MAVAUT will apply a deduction equal to 50% of the amount paid. Failure of the Client to show up on the scheduled day for the Activity, and/or the Participant(s) for whom the Activity was booked and the Contract concluded, will be treated as a last-minute cancellation by the Client and will not be eligible for a refund. For groups with bookings based on a quote, the deposit will be retained in case of cancellation up to 15 days before the activity.

8.4 Modification of the Booking Date It is possible to request a change to the scheduled date for the activity, if this is technically feasible and compatible with the activity. Such requests must be sent directly by email to the following address: damnature04@gmail.com

If the modification is possible, you will receive a new booking summary. However, it is important to note that due to availability reasons, your modification request may be refused; in this case, it will be treated as a cancellation and will fall under the general cancellation policy as detailed above. 8.5 Disputes Any claim regarding the supervision of activities must be sent by registered letter with acknowledgment of receipt within one month after the date of the activity. The parties will make every effort to amicably resolve any difficulties that may arise in the performance of the contract. If no amicable agreement can be reached, all disputes relating to the validity, interpretation, and execution of this agreement will be governed exclusively by French law.

9 – Respect for privacy and personal data

9.1 Right of access and modification of your data In accordance with the French Data Protection Act No. 78-17 of January 6, 1978, regarding data processing, files, and freedoms, you have the rights to object (Article 26 of the law), access (Articles 34 to 38 of the law), and rectify (Article 36 of the law) the data concerning you. Thus, you may contact us (see the site owner's address above) to have your information that is inaccurate, incomplete, ambiguous, outdated, or whose collection, use, disclosure, or storage is prohibited, corrected, completed, updated, or deleted. The information concerning you is intended solely for us. We do not under any circumstances transmit this information to any third party.

9.2 Network Security and Privacy Messages that you send to us via the internet can be intercepted on the network before they reach us, and their confidentiality cannot be guaranteed. Make sure not to disclose unnecessary personal or confidential information, sensitive data, or information belonging to third parties. Additionally, the origin of the emails we receive can be forged. Therefore, if you wish to communicate such information to us, you must use postal mail. Consequently, no complaints, statements, or requests for advice sent via internet message will be considered. Please submit your requests exclusively by postal mail. For more information on procedures to follow or ongoing cases, please contact the site owner in writing.

9.3 Hyperlinks
The hyperlinks present on the site that direct users to other websites do not engage our responsibility regarding the content of these sites. Any individual or legal entity wishing to have a link (address of their site) established from our site must request authorization in advance. Establishing a link to our site does not require authorization. We disclaim all responsibility in this case.
